Original Petition No. 29 of 1990

Consumer Ptorection Council, Rourkela             ....  Complainant
Vs.
M/s Andhra Pradesh Scooters Ltd.                    ..... Opposite Party

Before : Hon'ble Justice V. Balakrishna Eradi

ORDER

The facts of this case are substantially simillar to those involved in O.P. No.15 of 1990, Mumbai Grahak Panchayat Vs. LML Limited, the only difference being that the respondent in the present case is an undertaking owned by the State Government of Andhra Pradesh, by name Andhra Pradesh Scooters Ltd. It is not disputed by the respondent that in respect of the 227 persons whose details are furnished in the Annexure, repayment of booking advance deposits had fallen due long ago and those amounts have not so far been repaid by the respondent company. In our opinion the proper order to be passed in this case alsop is to direct the respondant to refund to all the 227 persons mentioned in the Annexure, the amounts due to them by way of return of the booking advanced deposites with interest at 18 % per annum from the date of receipt of advice of cancellation of the booking. Such payment should be effected by the respondent company within a period not exceeding two months from today. We consider that the award of 18 % interest would adequately compensate the petitioners for the inconvenience, harssment and loss caused to them by the reason of  the enormous dealy on the part of the respondent in refunding the deposit amounts. This petition will stand disposed with aforesaid direction.
